Welcome to ENVÍOPACK. Please read on to learn the rules and restrictions that govern the use of our website, products, services, and applications (hereinafter the "Services").

Please note that these terms of use (hereinafter the "Terms") form a legally binding agreement between you and ENVÍOPACK. It is important that you take the time to read them carefully. You must accept these Terms; otherwise, you will not be entitled to use our Services.

1 - TERM OF THESE TERMS

These Terms may change at some point. ENVÍOPACK reserves the right to change the Terms at any time. If the changes have a material impact, we will make an effort to notify you through notices posted on the ENVÍOPACK website, by email, and/or through other means.

If you disagree with the new Terms, you may always reject them, although unfortunately that will mean you can no longer use the Services. If you use the Services in any way after a change to the Terms takes effect, it means you accept all changes.

2 - SERVICE FEATURES

The owner of the website www.enviopack.com ("Website") is ENVIOPACK S.A.

ENVÍOPACK's services allow you to search, compare, and select different logistics operators (hereinafter "Provider") to ship the materials and goods you have purchased, choosing the ones that best suit your preferences. Through ENVÍOPACK, you can compare the benefits and attributes of each Provider in a unified and transparent way, deciding which one to use for each destination.

You may use the Services to hire a third-party courier or messaging service, and ENVÍOPACK will provide you with the appropriate postage evidence — for example, a shipping label — to use with your shipments. ENVÍOPACK acts as an intermediary between you and your selected Provider. ENVÍOPACK does not transport or deliver shipments.

To take advantage of this service, you must register for an account and choose a password and username. You agree to provide us with accurate, complete, and up-to-date registration information. You may not select as your ENVÍOPACK user ID a name you have no right to use, or another person's name with the intent to impersonate that person. You may not transfer your account to any other person without our prior written permission. You may also not register more than once.

You represent and warrant that you are of legal age to enter into a binding contract (or, if not, that you have received permission from your parents or guardians to use the Services and have had them accept these Terms on your behalf). If you are accepting these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to do so and that you bind that organization or entity to these Terms.

3 - LEGAL RESTRICTIONS

As a condition of your use of this Website, you warrant to ENVÍOPACK that you will not use the Website for any purpose that is illegal or prohibited by these Terms, or by the laws and regulations of the jurisdiction in which you are located or to which an envelope or package has been sent. You may not use the Website in any way that could damage, disable, overburden, or impair it. You may not obtain or attempt to obtain any material or information through any means not intentionally made available or provided through the Website. ENVÍOPACK reserves the right at all times to disclose any information as necessary to comply with any law, regulation, legal process, or governmental request.

Additionally, ENVÍOPACK reserves the right to cancel or restrict access to the Website for certain users, should it observe any conduct that, in ENVÍOPACK's judgment, violates these Terms, the law, morality, or good practices, or could disrupt the proper functioning, image, credibility, and/or reputation of ENVÍOPACK or its collaborators. ENVÍOPACK may also hold users liable for damages resulting from misuse of the Website.

4 - WEBSITE COPYRIGHT / USE THEREOF

You acknowledge that (i) the content of the Website and the content available through the Services are protected by copyright, trademarks, and other intellectual and property rights ("Rights"); (ii) these Rights are valid and protected across all media and technologies that exist now or may exist in the future; and (iii) unless explicitly stated otherwise, the Terms and applicable copyright, trademark, and other laws govern the use of such content.

Any other use — including, but not limited to, reproduction, modification, distribution, transmission, duplication, copying, sale, display, or performance of the content of this Website — is strictly prohibited.

"Content" refers in particular to designs, icons, software, photographs, models, illustrations, soundtracks, texts, logos, trademarks, or any other signs susceptible to industrial and commercial use that make up the Website.

Under no circumstances shall any license be deemed granted, nor any waiver, transfer, or total or partial assignment of such rights be deemed made, nor shall any right or expectation of right be conferred — particularly with respect to alteration, exploitation, reproduction, distribution, public communication, or making available of such content — without the prior express authorization of ENVÍOPACK or the respective rights holders.

ENVÍOPACK reserves the right to refuse service, cancel accounts, and/or cancel orders at its discretion, including, without limitation, if ENVÍOPACK believes that a user's conduct violates applicable law or is harmful to ENVÍOPACK's interests. Any use of content or descriptions; any derivative use of this Website or its contents; and any use of data mining, robots, or similar data collection and extraction tools are strictly prohibited. Under no circumstances shall any user frame any portion of the Website or any content within it. By using this Website, you agree to comply with all applicable laws and regulations, including the export and re-export control laws and regulations of the Argentine Republic.

5 - TRADEMARKS

ENVÍOPACK is a registered trademark under the laws of the Argentine Republic. ENVÍOPACK's trademarks and trade dress may not be used in connection with any product or service in a way that could cause confusion among customers, or in any way that could be interpreted as disparagement of the business. All trademarks not owned by ENVÍOPACK are the property of their respective owners. You may not use — and nothing contained on the Website or in these Terms grants, by implication, waiver, estoppel, or otherwise — any right to use any trademark displayed on the Website without the written permission of ENVÍOPACK or the respective owner of that trademark, service mark, or logo.

6 - COPYRIGHT INFRINGEMENT

ENVÍOPACK respects the intellectual property of others. Any copyright infringement will not be tolerated.

While the Agreement is in effect, ENVÍOPACK may include your company's logo and profile on any website it maintains for ENVÍOPACK service customers. You agree to the publication of your company name by ENVÍOPACK as an ENVÍOPACK customer.

7 - SOFTWARE AVAILABLE ON THE SITE

The software available from the Website ("Software") is the copyrighted work of ENVÍOPACK. Your use of the Software is governed by these Terms. You may not use any Software or the Website unless you first accept the Terms, after which ENVÍOPACK grants you, the user, a personal and non-transferable license to access the Software to view and use the Website in accordance with these Terms, and for no other purpose, provided you keep intact all intellectual property notices and other proprietary notices contained in the Software. All software is the property of ENVÍOPACK and is protected by copyright law. Any reproduction or redistribution of the Software is expressly prohibited by law and may result in severe civil and criminal penalties. Infringers will be prosecuted to the fullest extent possible. WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCING THE SOFTWARE TO ANY SERVER OR OTHER LOCATION FOR THE PURPOSE OF REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED. You acknowledge that the Software, and all accompanying documentation and/or technical information, is subject to the applicable export control laws and regulations of the Argentine Republic.

Use of the software is subject to compliance with these Terms and is provided without additional consideration on a non-transferable, limited, revocable, and royalty-free basis.

8 - PRIVACY POLICY

In compliance with Law 25,326 (Personal Data Protection), we inform you that the personal data you provide us will be included in a file owned by ENVÍOPACK, for the purpose of managing contracted transport services, the accounting and administrative management of customers, and/or the management of any promotion in connection with which such data was requested. Personal data may be shared with other companies affiliated with and/or subsidiary to ENVÍOPACK solely for the fulfillment of the purposes mentioned above, always respecting the duty of confidentiality.

Personal data collected may also be processed for the purpose of conducting market research to improve services and their quality, as well as to keep you informed by mail, telephone, and/or electronic means about ENVÍOPACK's services and promotions related to the transport sector and related activities (commercial communications). Accordingly, the data subject expressly consents to the use of their personal data for the purposes indicated.

The data subject may exercise their rights of access, rectification, cancellation, and objection.

We inform you that all your information is protected in our systems. Only employees who require the information to perform a specific task will have access to it. Our employees are required to adopt the security measures required by current legislation. While absolute security on the Internet cannot be guaranteed, you can be assured that we have established security measures to protect the confidentiality of your information. We will continue to maintain and improve these measures over time in accordance with legal and technological developments.

ENVIOPACK reserves the right to modify this Privacy Policy statement at any time and in response to changes affecting applicable privacy and data protection legislation.

9 - LIABILITY

The Services may contain links or connections to couriers and/or providers or other third-party websites or services that are not owned or controlled by ENVÍOPACK. The display through the Website of delivery service options offered by third parties does not in any way imply, suggest, or constitute an endorsement or sponsorship of us by such courier, or any affiliation between such Provider and us. Our display of specific options does not suggest a recommendation by us of the courier or its delivery options.

You agree that we are in no way responsible for the accuracy, timeliness, delays, or completeness of information you may obtain from these Providers. Your interaction with any Provider or other third party found through our Services — including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such transactions — is entirely at your own risk. You agree that ENVÍOPACK shall have no liability with respect to the acts, omissions, errors, representations, warranties, breaches, or negligence of any Provider or other third party, or for any personal injury, death, property damage, or other damages or expenses resulting in any way from your interactions with any Provider.

You agree to comply with the terms or conditions of purchase imposed by any Provider you choose to deal with. Circumventing a Provider's rules is prohibited. The use of prohibited practices may result in the cancellation of your account, and the Provider may take action including canceling a service order, denying delivery, charging additional fees to your credit card, imposing additional charges at delivery or pickup, or future billing.

When you access third-party websites or use third-party services, you agree that there are risks in doing so, and that ENVÍOPACK is not responsible for those risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third-party website or service you visit or use. ENVÍOPACK has no control over and assumes no responsibility for the content, accuracy, privacy policies, or practices or opinions expressed on third-party websites or by any third party you interact with through the Services. Furthermore, ENVÍOPACK shall not be able to monitor, verify, censor, or edit the content of any third-party site or service. By using the Services, you release and hold us harmless from any liability arising from your use of any third-party website or service.

Any information or content publicly posted or privately transmitted through the Services is the sole responsibility of the person from whom such content originated, and you access all such information and content at your own risk. We are not responsible for any errors or omissions in that information or content, or for any damage or loss you may suffer in connection with it. We cannot control and have no obligation to take any action regarding how you may interpret and use the content or what actions you may take as a result of having been exposed to it, and you hereby release us from all liability for having acquired or not acquired content through the Services. We cannot guarantee the identity of any users with whom you interact while using the Services, and we are not responsible for which users access the Services.

If there is a dispute between participants on this site, or between users and Providers or any other third party, you agree that ENVÍOPACK has no obligation to become involved. In the event that you have a dispute with one or more users, you release ENVÍOPACK, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.

10 - PAYMENT METHODS – CREDIT LOADING

To use your account for postal shipping transactions and other additional services, you must pre-fund your user account.

All purchases and debits will be reflected in your user account once the transaction is completed. Label creation will be permitted as long as all service fees have been paid.

If any service payment cannot be successfully completed, your account will be suspended until payment is made, without any notification being required.

ENVÍOPACK currently accepts bank transfers, the details of which can be found at: app.enviopack.com/créditos/recarga.

Regarding other payment methods, ENVÍOPACK uses Mercadopago services. For information on the different payment options and fees available through Mercadopago, visit: app.enviopack.com/créditos/recarga.

11 - PRICING POLICY

You can find information on the different Provider rates at the following link: App.enviopack.com/correos-y-tarifas.

ENVÍOPACK reserves the right to modify the rates mentioned above at any time by updating them at the link indicated above.

ENVÍOPACK will send you an invoice for the total amount loaded into your user account.

You must provide current (e.g., you must notify us of any change in billing address, credit card number, expiration date, etc.), complete, and accurate payment and billing information for your account.

ENVÍOPACK shall not be responsible for any local customs charges, taxes, import duties, or similar charges incurred in connection with the transport and/or delivery of any shipment. You must determine whether any such charges will apply and, if so, in what amounts, before completing an order with us. If any such charges become due as a result of the transport and/or delivery of a shipment on your behalf and are billed to us by any competent authority, you agree to reimburse us the full amount within 7 days of our demand.

12 - COST ADJUSTMENTS

If you carry out a transaction with ENVÍOPACK and, for example, the shipment information is found to be incorrect or the Provider makes a price change, the transaction amount will be automatically deducted from your ENVÍOPACK account balance.

In the event of a discrepancy between the shipment information and what has been declared by the Provider, a temporary period of 90 days is established during which you must verify that the information and charges imposed by the Provider are correct. If there is a difference, you have 7 days to submit the relevant documentation proving the accuracy of the shipping information originally declared. ENVÍOPACK will make a decision regarding the matter, which will be communicated to you by email.

If payments for ENVÍOPACK Services cannot be charged to your account due to insufficient available funds, ENVÍOPACK may claim such charge directly from you by issuing the corresponding delinquent account certificate. You agree that such certificate issued by ENVÍOPACK has executive force.

13 - REFUNDS

You may request a refund of the credit loaded into your user account, which will be processed in the same manner in which it was loaded, minus any costs incurred by ENVÍOPACK for the operation, which will be duly communicated.

14 - SHIPMENT PROTECTION

If your order is protected and an incident occurs, the ENVÍOPACK team will notify you so that within the following 7 calendar days you can submit the required documentation through the Contact Center, as applicable.

It is very important that the declared value of the package and the buyer's details on the invoice you submit match those entered in ENVÍOPACK at the time the order was processed.

Important:

If the shipment is protected and a refund applies, it will be credited to the user's account and may only be used as credit for future transactions.

If the required documentation is NOT submitted within 7 (seven) calendar days following notification of the incident, the claim will not be recognized.

15 - RIGHT OF INSPECTION

You agree that ENVÍOPACK, its partners, or any governmental authority — including customs and security — may open and inspect your shipment at any time. They may also dispose of a package if it is determined that such disposal is required or if there is suspicion of fraud associated with the transaction.

16 - ACCOUNT CANCELLATION

You may terminate or close your account at any time. However, depending on the service plan you selected, certain restrictions or fees may apply, as detailed below. To cancel, you may do so by accessing your account online. You will be asked to verify your account information and confirm your intent to cancel.

Upon deactivation of your account for any reason, all outstanding invoices must be paid immediately. Any remaining credit in ENVÍOPACK accounts will not be refunded and will be applied toward the respective account cancellation costs.

17 - INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless ENVIOPACK, its affiliates, officers, agents, employees, and partners from and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorney's fees) arising from any third-party claim related to (a) your use of the Services (including actions taken by a third party using your account), (b) your violation of these Terms, and (c) your violation of any rules, policies, terms of service, or agreements between a Provider and you.

18 - APPLICABLE JURISDICTION

The Parties agree to submit the resolution of any dispute and/or controversy arising under this Agreement to the National Courts with jurisdiction in Civil and/or Commercial matters located in the Autonomous City of Buenos Aires, expressly waiving any other venue and/or jurisdiction that may otherwise apply.
